Learn when EU Machinery Regulation 2023/1230 applies, which topics change and how machinery manufacturers can prepare their documentation and processes.
When does the Machinery Regulation apply?
Regulation (EU) 2023/1230 entered into force on 19 July 2023 and, apart from provisions with different dates, applies from 20 January 2027. Machinery placed on the market before that date generally remains subject to Machinery Directive 2006/42/EC.
There is no general transition period in which manufacturers can freely choose between both regimes. Plan the market date for each product and determine which rules apply at that time.
Why a regulation instead of a directive?
An EU regulation applies directly across Member States. This supports more uniform application without first transposing the main text into national law. The new rules retain familiar principles such as risk assessment, essential health and safety requirements, technical documentation and CE marking.
Existing documentation therefore does not need to start from zero, but terminology, legal references, procedures and content should be checked against the new Regulation.
Important changes for machinery manufacturers
Impact varies by product. The Regulation updates the treatment of digital technology, documentation and certain categories with a higher risk profile.
A new structure for certain machinery categories in Annex I and adjusted conformity procedures
Explicit protection against corruption of safety-related software and data
Requirements addressing machinery with self-evolving behaviour or AI-related safety functions
Options to provide instructions and declarations digitally when conditions are met
Updated definitions and duties for manufacturers, importers, distributors and other economic operators
Technical documentation under Annex IV and declarations under Annex V
Digital instructions are not digital without limits
The Regulation permits digital instructions subject to conditions. Manufacturers must explain how to access them, keep them available for the required period and provide a paper copy free of charge within the specified period when requested.
For machinery intended for non-professional users, safety information essential for putting the machinery into service and using it safely must still be provided on paper. Check the final applicable text for your situation.
A practical preparation plan
Create a product and project overview with expected market dates around January 2027. Perform a gap analysis covering definitions, applicable requirements, Annex I, conformity procedures, technical documentation, declarations and digital instructions.
Update templates, software, responsibilities and review gates. Train engineers and reviewers before the first dossiers are released under the Regulation. Clearly retain which legal framework and standard versions were used for every machine.
How DME-CE supports the transition
DME-CE supports documentation for both Machinery Directive 2006/42/EC and Machinery Regulation 2023/1230/EU. Teams can record which requirements apply to each dossier and align evidence, risks, instructions and declarations.
The manufacturer remains responsible for applicability decisions and technical content. Use the official Regulation and current European Commission information as primary sources.
